By placing an order through the Philips Hong Kong Online Store, you accept and agree to be legally bound by the Terms of Use, Terms and Conditions of Sale, Privacy Notice and any other terms and conditions published on this website. If you do not agree and/or accept any of these terms and conditions, do not use our online store services.
1. Definitions
1.1 "Philips" refers to Philips Electronics Hong Kong Limited, hereinafter referred to as "we", "us" and/or "our".
1.2 "Products" means products, spare parts, accessories and/or consumables of Philips branded products sold on the Website.
1.3 "Online Store Services" means any online store services provided by Philips on this website.
1.4 "Customer" means you who access and/or place an order through the Website, hereinafter referred to as "you", and/or "your".
1.5 "Order" means the selected Products that you intend to purchase through the Website.
1.6 "Contract" means the terms and conditions we have entered into with you in relation to our sale of Products and your purchase of Products.
1.7 "Website" means the Philips Hong Kong Online Store https://shop.philips.com.hk
2. Formation of Contract
2.1 Nothing on this website constitutes an offer of any kind by us.
2.2 Notwithstanding any notice generated by the system, acceptance of your order shall be at our sole discretion and subject to availability.
2.3 The contract is formed when we give you a confirmation notice by e-mail.

3. Prices and Payment
3.1 The price of the Products shall be based on the date and time you place your order stated on the Website.
3.2. All prices are in Hong Kong dollars. The price shall be the price published on the Website at the time you submit your order. Prices published on the website do not include delivery fees. Delivery charges will be calculated separately and noted on the order as applicable and added to the total price of the order.
3.3 You should settle your bill through a designated payment service provider (e.g. PayPal, SHOPLINE Payments). By proceeding with the payment, you also agree to the terms and agreements, if any, prepared by the designated payment service provider.
3.4 Products are while stocks last. If, for any reason, any or all of the products you have ordered are out of stock, or if there is an error in price, product description or promotion, we may cancel and refund your order.
4. Delivery
4.1 We offer delivery services for products, spare parts, accessories and/or consumables for Philips branded products within Hong Kong and Macau via SF Express.
4.2 SF Express will use reasonable efforts to deliver the Products ordered to the Customer. Philips shall not be liable for any loss of profits or business, or any other direct, indirect, special, incidental or consequential damages resulting from late delivery or non-delivery of products.
4.3 In order to protect the interests of the Customer, you may be required to present an invoice upon delivery and/or collection. If the customer fails to present the relevant documents, we reserve the right to refuse delivery and/or collection.
4.4 Delivery to Hong Kong and Macau
4.4.1 Orders over HK$200 can enjoy free delivery within Hong Kong and Macau. For orders less than HKD200, a shipping fee of HKD50 will be charged.
4.4.2 Shipping costs, if applicable, are paid by customers as indicated on the invoice. Exact charges depend on the delivery area and additional charges may apply in designated remote or special warehousing areas. Additional fees/surcharges may also apply for fuel and resource allocation.

4.4.3 Once your order is dispatched, you will receive a confirmation email with an SF Express tracking number. You can check the shipment status by entering the tracking number on the SF Express website: https://htm.sf-express.com/hk/en/dynamic_function/waybill/

4.4.4 Please provide correct recipient phone number and delivery addresses. Any invalid shipments due to incorrect information, SF Express may have additional service charges, which shall be borne directly by the Customer. Additionally, SF Retention Service Fee will be applied if customers are unable to pick up their parcels within the designated period at SF Business Stations, SF Stores or EF Lockers. If we are unable to contact you within fourteen (14) days to arrange delivery, we reserve the right to cancel your order without prior notice.
4.4.5. Delivery service is available for Hong Kong Island, Kowloon, New Territories, Outlying Islands and Macau. Delivery is not available for addresses consisting solely of Post Office Boxes (PO boxes) or postal codes or ZIP codes. 4.4.6 All paid orders will generally be shipped by SF Express within 7 working days. Delivery time will be affected by weekends and public holidays. Delivery service will be suspended when Typhoon Signal No. 8 or above / Black Rainstorm Signal is hoisted. Delivery will be rescheduled after the signal is cancelled.
4.5 If you order various Products to be delivered to different addresses, you will need to submit a separate order for each delivery address. If you need to change the delivery address/telephone number/schedule delivery time, etc., after the payment of order is completed, please contact SF Express directly to change it. SF Express may have additional service charges for any changes on shipping method or delivery address after ordering, which shall be borne directly by the Customer. 4.6 Any delivery or shipment date shown is a best estimate only and we shall not be liable for any loss, damage, cost or expense caused by failure to deliver in accordance with the specified delivery or shipment date. If any of the products ordered are out of stock, this may mean that the entire order is delayed.
5. Receiving the product
5.1 You shall be deemed to have accepted the Products in perfect condition unless notified to us by telephone, fax and/or email within seven (7) days of delivery and/or collection.
5.2 If a defect is found after inspection and/or verification, we will repair and/or replace the Product at our sole discretion.
5.3 You will need to present the original receipt and/or delivery note for the Product for the repair and/or replacement process. If you fail to present the relevant documents, we reserve the right to refuse repair and/or replacement.
6. Ownership, Risk of Damage or Loss
6.1 Entitlement to the Products and the risk of damage or loss shall pass to the Customer upon delivery of the Products to the address specified by the Customer in the Order.
7 Warranty
7.1. The warranty policy of the Product is based on the warranty card accompanying the Product and/or the instructions on the official Philips website.
7.2. Unless otherwise stated, no warranty is provided for spare parts, accessories and/or consumables for Philips branded products sold on the Website.
8. Refunds
8.1 In general, we are unable to accept any requests for exchange or order cancellation.
8.2 You must immediately check whether the ordered products are damaged or missing upon receipt of goods. If you find that the ordered product is damaged, you can call our customer service department to arrange for exchange. If we agree that you have the right to exchange the product, but the requested replacement product has been sold out, we will refund the relevant amount to you.
8.3 We have the right to refuse requests to exchange products that have already been received due to product appearance and incomplete accessories.
8.4 Returned products must include complete packaging, accessories, instruction manual and empty warranty certificate. The returned product must not be broken, damaged or damp.
8.5 Products that have been registered online for warranty or have been repaired cannot be exchanged.
8.6 The product must be returned together with all the gifts included in the purchase, otherwise we will deduct the value of the gifts from the refund.
8.7 No refund will be made for shipping; or shipping costs will not be refunded to orders for which the refund request has been accepted.
8.8 Refunds/returns must be made in person at the designated authorized Philips Customer Service Centre.
8.9 No refunds, exchanges or returns will be accepted for a change of mind.

9. Resale
9.1 You agree and warrant that the Products purchased are for your own use only and may not be resold. We will, in our sole discretion, refuse to accept orders suspected for resale.
9.2 You undertake not to copy, duplicate, sell, resell or otherwise exploit for any commercial purpose any part of the Services, the use of or access to the Services.
10. Indemnification
10.1 You agree to indemnify and hold us harmless from and against all liabilities, claims, fines, losses, damages, costs and expenses (including reasonable attorneys' fees), whether direct or indirect, arising out of (i) inaccuracies caused by you, (ii) any willful or negligent act, omission, or error by you in connection with your online purchase of the Services, and/or (iii) any applicable law or regulation that you violate.
11. Governing Law
11.1 The Terms and Conditions shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China.
11.2 The parties agree to submit these Terms and Conditions to the jurisdiction of the courts of the Hong Kong Special Administrative Region of the People's Republic of China.
12. Waiver
12.1 If any provision of these Terms and Conditions becomes or is declared illegal, unenforceable or invalid by a court or governmental authority of competent jurisdiction, the other terms and conditions shall survive in full force and effect in the absence of such provision.
13. Force Majeure
13.1 We shall not be liable for force majeure, acts of terrorism, outbreak of hostilities, riots, civil commotion, acts of any government or authority (including revocation of any license or consent), fire, explosion, flood, fog or severe weather, breach of contract by suppliers or subcontractors, theft, vandalism, lock-out or industrial action of any kind, any cause or circumstance that cannot reasonably be foreseen and/or is beyond our reasonable control.
14. Changes to the Terms and Conditions
14.1 We reserve the right to change the terms and conditions without prior notice.
